Package of measures for the Implementation of the Minsk
agreements
1. Immediate and comprehensive ceasefire in certain areas of the
Donetsk and Lugansk regions of Ukraine and its strict implementation
starting from 00.00 AM (Kiev time) on the 15th of February, 2015.
2. Withdrawal of heavy weapons by both sides on equal distances in
order to create a security zone at least 50 km wide from each other
for the artillery systems with caliber greater than 100mm and more,
a security zone of 70 km wide for MLRS and 140 km wide for MLRS
“Tornado-C”, “Uragan”, “Smerch” and Tactical missile systems
“Tochka” (“Tochka U”):
- for the Ukrainian troops: from the de facto line of contact;
- for the armed formations from certain areas of the Donetsk and
Lugansk oblast of Ukraine from the line of contact according to the
Minsk memorandum of September 19, 2014.
The withdrawal of the heavy weapons as specified above is to start
on day 2 of the ceasefire at the latest and to be completed within
14 days.
The process shall be facilitated by the OSCE and supported by the
Trilateral Contact Group.
3. Ensure effective monitoring and verification of the ceasefire
regime and the withdrawal of heavy weapons by the OSCE from the day
1 of the withdrawal, using all technical equipment necessary,
including satellites, drones, radar equipment, etc.
4. Launch a dialogue, on day 1 of the withdrawal on modalities of
local elections in accordance with Ukrainian legislation and the Law
of Ukraine “On interim local self-government order in certain areas
of the Donetsk and Lugansk regions” as well as on the future regime
of these areas based on this Law.
Adopt promptly, by no later than 30 days after the date of signing
of the document a
resolution of the Parliament of Ukraine specifying the area enjoying
the special regime, under the Law of Ukraine On interim local
self-government order in certain areas of the Donetsk and Lugansk
regions”, based on the line of the Minsk Memorandum of September 19,
2014.
5. Ensure pardon and amnesty by enacting the law prohibiting the
prosecution and punishment of persons in connection with the events
that took place in certain areas of the Donetsk and Lugansk regions
of Ukraine.
6. Ensure release and exchange of all hostages and unlawfully
detained persons, based on the principle “all for all”. This process
is to be finished on the day 5 after the withdrawal at the latest.
7. Ensure safe access, delivery, storage, and distribution of
humanitarian assistance to those in need, on the basis of an
international mechanism.
8. Definition of modalities of full resumption of socio-economic
ties, including social transfers, such as pension, payments and
other payments (incomes and revenues, timely payments of all utility
bills, reinstating taxation within the legal framework of Ukraine).
To this end, Ukraine shall reinstate control of the segment of its
banking system in the conflict affected areas and possibly an
international mechanism to facilitate such transfers shall be
established.
9. Reinstatement of full control of the state border by the
government of Ukraine throughout the conflict area, starting on day
1 after the local elections and ending after the comprehensive
political settlement (local elections in certain areas of the
Donetsk and Lugansk regions on the basis of the Law of Ukraine and
constitutional reform) to be finalized by the end of 2015, provided
that paragraph 11 has been implemented in consultation with and upon
agreement by representatives of certain areas of the Donetsk and
Lugansk regions in the framework of the Trilateral Contact Group.
10. Withdrawal of all foreign armed formations, military equipment,
as well as mercenaries from the territory of Ukraine under
monitoring of the OSCE. Disarmament of all illegal groups.
11. Carrying out constitutional reform in Ukraine with a new
Constitution entering into force by the end of 2015, providing for
decentralization as a key element (including a reference to the
specificities of certain areas in the Donetsk and Lugansk regions,
agreed with the representatives of these areas), as well as adopting
permanent legislation on the special status of certain areas of the
Donetsk and Lugansk regions in line with measures as set out in the
footnote until the end of 2015i.
12. Based on the Law of Ukraine “On interim local self-government
order in certain areas of the Donetsk and Lugansk regions”,
questions related to local elections will be discussed and agreed
upon with representatives of certain areas of the Donetsk and
Lugansk regions in the framework of the Trilateral Contact Group.
Elections will be held in accordance with relevant OSCE standards
and monitored by OSCE/ODIHR.
13. Intensify the work of the Trilateral Contact Group including
through the establishment of working groups on the implementation of
relevant aspects of the Minsk agreements. They will reflect the
composition of the Trilateral Contact Group.

Such measures are, according to the Law on the special order for
local self government in certain areas of the Donetsk and Lugansk
regions:
- Exemption from punishment, prosecution and discrimination for
persons involved in the events that have taken place in certain
areas of the Donetsk and Lugansk regions;
- Right to linguistic self-determination;
- Participation of organs of local self-government in the
appointment of heads of public prosecution offices and courts in
certain areas of the Donetsk and Lugansk regions;
- Possibility for certain governmental authorities to initiate
agreements with organs of local self government regarding the
economic, social and cultural development of certain areas of the
Donetsk and Lugansk regions;
- State supports the social and economic development of certain
areas of the Donetsk and Lugansk regions;
- Support by central government authorities of cross-border
cooperation in certain areas of Donetsk and Lugansk regions with
districts of the Russian Federation;
- Creation of the people’s police units by decision of local
councils for the maintenance of public order in certain areas of the
Donetsk and Lugansk regions;
- The powers of deputies of local councils and officials, elected at
early elections, appointed by the Verkhovna Rada of Ukraine by the
law, cannot be early terminated.

Text of the
agreement
The full text of the agreement is as follows:[37][38]
- Immediate and full ceasefire in particular districts of Donetsk and Luhansk oblasts of Ukraine and its
strict fulfilment as of 00:00 midnight EET on 15 February 2015.
- Pull-out of all heavy weapons by both sides to equal distance
with the aim of creation of a security zone on minimum 50
kilometres (31 mi) apart for artillery of 100mm calibre or
more, and a security zone of 70 kilometres (43 mi) for multiple
rocket launchers (MRLS) and 140 kilometres (87 mi)
for MLRS Tornado-S, Uragan, Smerch, and Tochka U tactical
missile systems:
- for Ukrainian troops, from actual line of contact;
- for armed formations of particular districts of Donetsk and
Luhansk oblasts of Ukraine, from the contact line in
accordance with the Minsk
Memorandum as of 19 September 2014 The pullout of the
above-mentioned heavy weapons must start no later than the
second day after the start of the ceasefire and finish
within 14 days. This process will be assisted by OSCE with the support
of the Trilateral
Contact Group.
- Effective monitoring and verification of ceasefire regime and
pullout of heavy weapons by OSCE will be provided from the first
day of pullout, using all necessary technical means such as
satellites, drones, radio-location systems etc.
- On the first day after the pullout a dialogue is to start on
modalities of conducting local elections in accordance with the
Ukrainian legislation and the Law of Ukraine "On temporary Order
of Local Self-Governance in Particular Districts of Donetsk and
Luhansk Oblasts," and also about the future of these districts
based on the above-mentioned law. Without delays, but no later
than 30 days from the date of signing of this document, a
resolution has to be approved by the Verkhovna
Rada of Ukraine, indicating the territory which falls
under the special regime in accordance with the law "On
temporary Order of Local Self-Governance in Particular Districts
of Donetsk and Luhansk Oblasts," based in the line set up by the
Minsk Memorandum
as of 19 September 2014.
- Provide pardon and amnesty by way of
enacting a law that forbids persecution and punishment of
persons in relation to events that took place in particular
districts of Donetsk and Luhansk oblasts of Ukraine.
- Provide release and exchange of all hostages and illegally
held persons, based on the principle of "all for all". This
process has to end – at the latest – on the fifth day after the
pullout (of weapons).
- Provide safe access, delivery, storage and distribution of
humanitarian aid to the needy, based on an international
mechanism.
- Define the modalities of a full restoration of social and
economic connections, including social transfers, such as
payments of pensions and other payments (income and revenue,
timely payment of communal bills, restoration of tax payments
within the framework of Ukrainian legal field).With this aim,
Ukraine will restore management over the segment of its banking
system in the districts affected by the conflict, and possibly,
an international mechanism will be established to ease such
transactions.
- Restore control of the state border to the Ukrainian
government in the whole conflict zone, which has to start
on the first day after the local election and end after the full
political regulation (local elections in particular districts of
Donetsk and Luhansk oblasts based on the law of Ukraine and
Constitutional reform) by the end of 2015, on the condition of
fulfilment of Point 11 – in consultations and in agreement with
representatives of particular districts of Donetsk and Luhansk
oblasts within the framework of the Trilateral Contact
Group.
- Pullout of all foreign armed
formations, military equipment, and also mercenaries from the
territory of Ukraine under OSCE supervision. Disarmament of all
illegal groups.
- Constitutional reform in Ukraine, with a new constitution to
come into effect by the end of 2015, the key element of which is
decentralisation
(taking into account peculiarities of particular districts of
Donetsk and Luhansk oblasts, agreed with representatives of
these districts), and also approval of permanent legislation on
the special status of particular districts of Donetsk and
Luhansk oblasts in accordance with the measures spelt out in the
attached footnote,[note
1] by the end of 2015.
- Based on the Law of Ukraine "On temporary Order of Local
Self-Governance in Particular Districts of Donetsk and Luhansk
Oblasts", questions related to local elections will be discussed
and agreed upon with representatives of particular districts of
Donetsk and Luhansk oblasts in the framework of the Trilateral
Contact Group. Elections will be held in accordance with
relevant OSCE standards and monitored by OSCE/ODIHR.
- Intensify the work of the Trilateral Contact Group including
through the establishment of working groups on the
implementation of relevant aspects of the Minsk agreements. They
will reflect the composition of the Trilateral Contact Group.

Excellency,
I have the honour to transmit herewith elements of the Plan of
Mr. Petro Poroshenko, President of Ukraine, on peaceful settlement
of the situation in the Eastern regions of Ukraine, elaborated
taking into consideration work of the Trilateral Contact Group,
composing of representatives of Ukraine, the Russian Federation and
the OSCE, as well as outcome of the meeting of the Head of State
with the representatives of Lugansk and Donetsk regions. President
Petro Poroshenko has already initiated implementation of the Plan by
ordering unilateral cease-fire in the East of Ukraine from 10.00
p.m. 20 June till 10:00 a.m. 27 June (Kyiv time).
Within this period, the wide range of issues covering the cessation
of use of force and the launch of peaceful settlement process will
be discussed. I believe that the Peace Plan will give momentum for
restoration of peace and order in the East of Ukraine and I hope
that it will be supported by Your Excellency as well as by
international community.
Your Excellency's steadfast support and efforts to de-escalate the
situation in Ukraine and your personal engagement is very much
appreciated by the Government and people of
Ukraine.
Availing-myself of this opportunity, please accept, Your Excellency,

On peaceful settlement of situation in the
Eastern regions of Ukraine
In the inaugural speech on June 7, 2014, President of Ukraine Petro
Poroshenko stressed that he was assuming the office in order to
preserve
the sovereignty, territorial integrity and national unity of
Ukraine, to ensure
the sustainable peace and to guarantee security for all citizens.
President Poroshenko's plan of peaceful settlement of situation in
the Eastern regions of Ukraine lies on three pillars:
- release from criminal responsibility for those, who
surrendered weapons, did not commit grave crimes against
Ukrainian military and civilians and was not involved in
illegal activities of financing terrorism;
- establishment of the controlled corridor for retreat of
Russian mercenaries;
- launch of inclusive dialogue with peaceful citizens.
Later on, the above Plan has been elaborated in details that
foresees:
1. Security guarantees to all members of negotiations.
2. Release from criminal responsibility for those, who surrendered
weapons and did not commit grave crimes.
3. Release of all hostages.
4. Setting up the t0 km buffer zone at the Ukrainian-Russian border
and the withdrawal of illegal troops and heavy weaponry.
5. Guaranteed corridor for retreat of Russian and Ukrainian
mercenaries.
6. Disarmament of illegally armed groups.
7. Establishment of joint patrolling units in the structure of the
Ministry of Interior.
8. Vacation of illegally seized official buildings in the Donetsk
and Luhansk regions.
9. Renewal of work of the local authorities.
10. Renewal of central TV and radio broadcasting in the region.
11. Decentralization of powers (through direct elections of local
executive committees; protection of the Russian language; draft
amendments to the Constitution).
12. Before the system of elections of local authorities is
introduced and takes effect, agreeing on the candidatures for the
posts of governors with representatives of the region (if there is
no agreed position on the nominees, the decision is made by the
President of Ukraine).
13. Early local and parliamentary elections.
14. Programme for creation of new jobs in the region.
15. Restoration of industrial and social infrastructure.
The technical issues regarding the implementation of the Peace plan
are being discussed within the framework of Trilateral Contact
Group, composing of representatives of Ukraine, the Russian
Federation and the OSCE.
According to the agreed common vision, the Plan will go through
several consecutive stages of implementation.
The first stage will cover the cessation of use of force for a short
limited period of time by the forces of Counter-terrorism operation
and the illegally armed groups. The forces of Counter-terrorism
operation will resume activities only in case of armed violence.
Within this period, the wide range of issues covering the cessation
of use of force and the launch of peaceful settlement process will
be discussed.
The second stage will cover the negotiation process itself.

Minsk protocol before it is finalised in the UN Security Council,
after which it is called commonly Minsk 2,to make it distinct from
what was initially formulated and then amended.)

Protocol on the outcome of consultations of
the Trilateral Contact Group on joint steps aimed at the
implementation of the Peace
Plan of the President of Ukraine, P. Poroshenko, and the initiatives
of the President of the Russian Federation, V. Putin
Upon consideration and discussion of the proposals put forward by
the participants of the consultations in Minsk on 1 September
2014, the Trilateral Contact Group, consisting of
representatives of Ukraine, the Russian Federation and the
Organization for Security and Cooperation in Europe (OSCE), reached
an understanding with respect to the need to implement the following
steps:
1. Ensure the immediate bilateral cessation of the use of weapons.
2. Ensure monitoring and verification by OSCE of the regime of
non-use of weapons.
3. Implement decentralization of power, including by enacting the
Law of Ukraine on the interim status of local self-government in
certain areas of the Donetsk and Luhansk regions (Law on Special
Status).
4. Ensure permanent monitoring on the Ukrainian-Russian State border
and verification by OSCE, along with the establishment of a security
area in the border regions of Ukraine and the Russian Federation.
5. Immediately release all hostages and unlawfully detained persons.
6. Enact a law prohibiting the prosecution and punishment of persons
in connection with the events that took place in certain areas of
the Donetsk and Luhansk regions of Ukraine.
7. Continue an inclusive national dialogue.
8. Adopt measures aimed at improving the humanitarian situation in
Donbass.
9. Ensure the holding of early local elections in accordance with
the Law of Ukraine on the interim status of local self-government in
certain areas of the Donetsk and Luhansk regions (Law on Special
Status).
10. Remove unlawful military formations and military hardware, as
well as militants and mercenaries, from the territory of Ukraine.
11. Adopt a programme for the economic revival of Donbass and the
resumption of vital activity in the region.
12. Provide personal security guarantees for the participants of the
consultations.

Annex II to the letter dated 24 February 2015 from the

Memorandum on the implementation of the
provisions of the Protocol on the outcome of consultations of
the Trilateral Contact Group on joint steps aimed at the
implementation of the Peace
Plan of the President of Ukraine, P. Poroshenko,
and the initiatives of the President of the Russian Federation, V.
Putin To carry out item 1 of the Protocol on the outcome of the
consultations of the Trilateral Contact Group on joint steps aimed
at the implementation of the Peace Plan of the President of
Ukraine, P. Poroshenko, and the initiatives of the President
of the Russian Federation, V. Putin, (Minsk, Republic of Belarus,
5 September 2014), the participants of the Trilateral Contact
Group, consisting of representatives of Ukraine, the Russian
Federation and the Organization for Security and Co-operation in
Europe (OSCE) and representatives of certain areas of the Donetsk
and Luhansk regions, have reached an understanding with respect to
the following measures to strengthen the bilateral ceasefire
agreement.
1. The ceasefire shall be considered mutual.
2. Both sides’ units and armed formations shall halt at their line
of contact as at 19 September 2014.
3. The use of all types of weapons and offensive action shall be
banned.
4. Within 24 hours after the approval of this Memorandum, all lethal
weapons of more than 100 millimetre calibre shall be moved back from
the line of contact on each side by at least 15 kilometres (with the
exception of those indicated below), including from residential
areas, to allow the establishment of a ceasefire zone of no less
than 30 kilometres in width (the secur ity zone).
At the same time, artillery systems of more than 100 millimetre
calibre shall be moved back from the line of contact to a distance
equal to the length of their maximum range, specifically:
– 100 mm canons MT12, by 9 kilometres; 120 mm mortars, by 8
kilometres; 122 mm howitzers D30 (2C1 Gvozdika), by 16 kilometres;
152 mm 2C5 Giatsynt-S (2C3 Akatsia, 2C19 Msta-S, 2A65 Msta-B), by 33
kilometres; multiple-launch rocket system (MLRS) 9K51 Grad, by 21
kilometres; 9K57 Uragan, by 36 kilometres; 9K58 Smerch, by 70
kilometres; MLRS Tornado-G,
by 40 kilometres; MLRS Tornado-U, by 70 kilometres; MLRS Tornado-C,
by 120 kilometres.
– Tactical rocket systems, by 120 kilometres.
5. Deployment of heavy weapons and military equipment shall be
banned in the district delimited by the towns of Komsomolsk,
Kumacheve, Novoazovsk and Sakhanka, with OSCE monitoring.
6. Installation of new mines and explosive barriers within the
limits of the security zone shall be banned. Mines and explosive
engineering barriers installed previously within the
security zone shall be dismantled.
7. As soon as this Memorandum is approved, flights by military
aircraft and foreign unmanned aerial vehicles (UAV), with the
exception of UAV used by the OSCE monitoring mission, shall be
banned along the line of contact in the ceasefire zone no less than
30 kilometres in width.
8. An OSCE monitoring mission consisting of OSCE observers shall be
deployed in the ceasefire zone within 24 hours of the approval of
this Memorandum.
The above-mentioned zone should be divided into sectors, the number
and limits of which shall be agreed upon as part of the preparations
for the work of the OSCE monitoring mission.
9. All foreign military formations and military equipment, as well
as militants and mercenaries, are to exit the territory of Ukraine
under OSCE monitoring.
